WORKING CONDITIONS OF TELEWORK IN SPANISH PUBLIC EMPLOYMENT (SPECIAL REFERENCE TO PERFORMANCE EVALUATION)

The regulation of the obligations and rights of public employees included in the scope of application of the Basic Statute of the Public Employee, who provide remote services, is one of the key issues of the current regulatory framework. The particularities of the legal regime of the Public Administrations are also reflected in this area, with a minimum common regulation based on the Basic Statute of the Public Employee, which is complemented by the regulations of the different administrations. This article analyses the aspects referring to rights and obligations of this minimum common regulation, which in turn conditions the development regulation of the Administrations, and some of the examples of territorial regulation, as well as the draft regulation on teleworking of the General State Administration, with special attention to the models of performance evaluation.
